Tytuł XVII. NAJEM
I DZIERŻAWA DZIAŁ I. NAJEM Rozdział I Przepisy
ogólne Art. 659. § 1. Przez
umowę najmu wynajmujący zobowiązuje się oddać najemcy rzecz do używania przez
czas oznaczony lub nie oznaczony, a najemca zobowiązuje się płacić wynajmującemu
umówiony czynsz. § 2. (249) Czynsz może być oznaczony w
pieniądzach lub w świadczeniach innego rodzaju. Art. 660. Umowa
najmu nieruchomości lub pomieszczenia na czas dłuższy niż rok powinna być
zawarta na piśmie. W razie niezachowania tej formy poczytuje się umowę za
zawartą na czas nie oznaczony. Art. 661. Najem
zawarty na czas dłuższy niż lat dziesięć poczytuje się po upływie tego
terminu za zawarty na czas nie oznaczony. Art. 662. § 1. Wynajmujący
powinien wydać najemcy rzecz w stanie przydatnym do umówionego użytku i
utrzymywać ją w takim stanie przez czas trwania najmu. § 2. Drobne
nakłady połączone ze zwykłym używaniem rzeczy obciążają najemcę. § 3. Jeżeli
rzecz najęta uległa zniszczeniu z powodu okoliczności, za które wynajmujący
odpowiedzialności nie ponosi, wynajmujący nie ma obowiązku przywrócenia stanu
poprzedniego. Art. 663. Jeżeli w
czasie trwania najmu rzecz wymaga napraw, które obciążają wynajmującego, a
bez których rzecz nie jest przydatna do umówionego użytku, najemca może
wyznaczyć wynajmującemu odpowiedni termin do wykonania napraw. Po
bezskutecznym upływie wyznaczonego terminu najemca może dokonać koniecznych
napraw na koszt wynajmującego. Art. 664. § 1. Jeżeli
rzecz najęta ma wady, które ograniczają jej przydatność do umówionego użytku,
najemca może żądać odpowiedniego obniżenia czynszu za czas trwania wad. § 2. Jeżeli
w chwili wydania najemcy rzecz miała wady, które uniemożliwiają przewidziane
w umowie używanie rzeczy, albo jeżeli wady takie powstały później, a
wynajmujący mimo otrzymanego zawiadomienia nie usunął ich w czasie
odpowiednim, albo jeżeli wady usunąć się nie dadzą, najemca może wypowiedzieć
najem bez zachowania terminów wypowiedzenia. § 3. Roszczenie
o obniżenie czynszu z powodu wad rzeczy najętej, jak również uprawnienie do
niezwłocznego wypowiedzenia najmu nie przysługuje najemcy, jeżeli w chwili
zawarcia umowy wiedział o wadach. Art. 665. Jeżeli
osoba trzecia dochodzi przeciwko najemcy roszczeń dotyczących rzeczy najętej,
najemca powinien niezwłocznie zawiadomić o tym wynajmującego. Art. 666. § 1. Najemca
powinien przez czas trwania najmu używać rzeczy najętej w sposób w umowie
określony, a gdy umowa nie określa sposobu używania - w sposób odpowiadający
właściwościom i przeznaczeniu rzeczy. § 2. Jeżeli
w czasie trwania najmu okaże się potrzeba napraw, które obciążają
wynajmującego, najemca powinien zawiadomić go o tym niezwłocznie. Art. 667. § 1. Bez
zgody wynajmującego najemca nie może czynić w rzeczy najętej zmian
sprzecznych z umową lub z przeznaczeniem rzeczy. § 2. Jeżeli
najemca używa rzeczy w sposób sprzeczny z umową lub z przeznaczeniem rzeczy i
mimo upomnienia nie przestaje jej używać w taki sposób albo gdy rzecz
zaniedbuje do tego stopnia, że zostaje ona narażona na utratę lub
uszkodzenie, wynajmujący może wypowiedzieć najem bez zachowania terminów
wypowiedzenia. Art. 668. § 1. Najemca
może rzecz najętą oddać w całości lub części osobie trzeciej do bezpłatnego
używania albo w podnajem, jeżeli umowa mu tego nie zabrania. W razie oddania
rzeczy osobie trzeciej zarówno najemca, jak i osoba trzecia są odpowiedzialni
względem wynajmującego za to, że rzecz najęta będzie używana zgodnie z
obowiązkami wynikającymi z umowy najmu. § 2. Stosunek
wynikający z zawartej przez najemcę umowy o bezpłatne używanie lub podnajem
rozwiązuje się najpóźniej z chwilą zakończenia stosunku najmu. Art. 669. § 1. Najemca
obowiązany jest uiszczać czynsz w terminie umówionym. § 2. Jeżeli
termin płatności czynszu nie jest w umowie określony, czynsz powinien być
płacony z góry, a mianowicie: gdy najem ma trwać nie dłużej niż miesiąc - za
cały czas najmu, a gdy najem ma trwać dłużej niż miesiąc albo gdy umowa była
zawarta na czas nie oznaczony - miesięcznie, do dziesiątego dnia miesiąca. Art. 670. § 1. Dla
zabezpieczenia czynszu oraz świadczeń dodatkowych, z którymi najemca zalega
nie dłużej niż rok, przysługuje wynajmującemu ustawowe prawo zastawu na
rzeczach ruchomych najemcy wniesionych do przedmiotu najmu, chyba że rzeczy
te nie podlegają zajęciu. § 2. (250) (skreślony). Art. 671. § 1. Przysługujące
wynajmującemu ustawowe prawo zastawu wygasa, gdy rzeczy obciążone zastawem zostaną
z przedmiotu najmu usunięte. § 2. Wynajmujący
może się sprzeciwić usunięciu rzeczy obciążonych zastawem i zatrzymać je na
własne niebezpieczeństwo, dopóki zaległy czynsz nie będzie zapłacony lub
zabezpieczony. § 3. W
wypadku gdy rzeczy obciążone zastawem zostaną usunięte na mocy zarządzenia
organu państwowego, wynajmujący zachowuje ustawowe prawo zastawu, jeżeli
przed upływem trzech dni zgłosi je organowi, który zarządził usunięcie. Art. 672. Jeżeli
najemca dopuszcza się zwłoki z zapłatą czynszu co najmniej za dwa pełne
okresy płatności, wynajmujący może najem wypowiedzieć bez zachowania terminów
wypowiedzenia. Art. 673. § 1. Jeżeli
czas trwania najmu nie jest oznaczony, zarówno wynajmujący, jak i najemca
mogą wypowiedzieć najem z zachowaniem terminów umownych, a w ich braku z
zachowaniem terminów ustawowych. § 2. Ustawowe
terminy wypowiedzenia najmu są następujące: gdy czynsz jest płatny w
odstępach czasu dłuższych niż miesiąc, najem można wypowiedzieć najpóźniej na
trzy miesiące naprzód na koniec kwartału kalendarzowego; gdy czynsz jest
płatny miesięcznie - na miesiąc naprzód na koniec miesiąca kalendarzowego;
gdy czynsz jest płatny w krótszych odstępach czasu - na trzy dni naprzód; gdy
najem jest dzienny - na jeden dzień naprzód. § 3. (251) Jeżeli czas trwania najmu jest
oznaczony, zarówno wynajmujący, jak i najemca mogą wypowiedzieć najem w
wypadkach określonych w umowie. Art. 674. Jeżeli po
upływie terminu oznaczonego w umowie albo w wypowiedzeniu najemca używa nadal
rzeczy za zgodą wynajmującego, poczytuje się w razie wątpliwości, że najem
został przedłużony na czas nie oznaczony. Art. 675. § 1. Po
zakończeniu najmu najemca obowiązany jest zwrócić rzecz w stanie nie
pogorszonym; jednakże nie ponosi odpowiedzialności za zużycie rzeczy będące
następstwem prawidłowego używania. § 2. Jeżeli
najemca oddał innej osobie rzecz do bezpłatnego używania lub w podnajem,
obowiązek powyższy ciąży także na tej osobie. § 3. (252) Domniemywa się, że rzecz była
wydana najemcy w stanie dobrym i przydatnym do umówionego użytku. Art. 676. Jeżeli
najemca ulepszył rzecz najętą, wynajmujący, w braku odmiennej umowy, może
według swego wyboru albo zatrzymać ulepszenia za zapłatą sumy odpowiadającej
ich wartości w chwili zwrotu, albo żądać przywrócenia stanu poprzedniego. Art. 677. Roszczenia
wynajmującego przeciwko najemcy o naprawienie szkody z powodu uszkodzenia lub
pogorszenia rzeczy, jak również roszczenia najemcy przeciwko wynajmującemu o
zwrot nakładów na rzecz albo o zwrot nadpłaconego czynszu przedawniają się z
upływem roku od dnia zwrotu rzeczy. Art. 678. § 1. W
razie zbycia rzeczy najętej w czasie trwania najmu nabywca wstępuje w
stosunek najmu na miejsce zbywcy; może jednak wypowiedzieć najem z
zachowaniem ustawowych terminów wypowiedzenia. § 2. Powyższe
uprawnienie do wypowiedzenia najmu nie przysługuje nabywcy, jeżeli umowa
najmu była zawarta na czas oznaczony z zachowaniem formy pisemnej i z datą
pewną, a rzecz została najemcy wydana. Art. 679. § 1. Jeżeli
wskutek wypowiedzenia najmu przez nabywcę rzeczy najętej najemca jest
zmuszony zwrócić rzecz wcześniej, aniżeli byłby zobowiązany według umowy najmu,
może on żądać od zbywcy naprawienia szkody. § 2. Najemca
powinien niezwłocznie zawiadomić zbywcę o przedwczesnym wypowiedzeniu przez
nabywcę; w przeciwnym razie przysługują zbywcy przeciwko najemcy wszelkie
zarzuty, których najemca nie podniósł, a których podniesienie pociągnęłoby za
sobą bezskuteczność wypowiedzenia ze strony nabywcy. Rozdział II Najem
lokalu(253) Art. 680. (254) Do najmu lokalu stosuje się
przepisy rozdziału poprzedzającego, z zachowaniem przepisów poniższych. Art. 6801. (255) § 1. Małżonkowie bez
względu na istniejące między nimi stosunki majątkowe są najemcami lokalu,
jeżeli nawiązanie stosunku najmu lokalu mającego służyć zaspokojeniu potrzeb
mieszkaniowych założonej przez nich rodziny nastąpiło w czasie trwania
małżeństwa. Jeżeli między małżonkami istnieje rozdzielność majątkowa, do
wspólności najmu stosuje się odpowiednio przepisy o wspólności ustawowej. § 2. Ustanie
wspólności ustawowej w czasie trwania małżeństwa nie pociąga za sobą ustania
wspólności najmu lokalu. Jednakże sąd, stosując odpowiednio przepisy o
zniesieniu wspólności majątkowej, może z ważnych powodów na żądanie jednego z
małżonków znieść wspólność najmu lokalu. Art. 681. Do
drobnych nakładów, które obciążają najemcę lokalu, należą w szczególności:
drobne naprawy podłóg, drzwi i okien, malowanie ścian, podłóg oraz
wewnętrznej strony drzwi wejściowych, jak również drobne naprawy instalacji i
urządzeń technicznych, zapewniających korzystanie ze światła, ogrzewania
lokalu, dopływu i odpływu wody. Art. 682. Jeżeli
wady najętego lokalu są tego rodzaju, że zagrażają zdrowiu najemcy lub jego
domowników albo osób u niego zatrudnionych, najemca może wypowiedzieć najem
bez zachowania terminów wypowiedzenia, chociażby w chwili zawarcia umowy
wiedział o wadach. Art. 683. Najemca lokalu
powinien stosować się do porządku domowego, o ile ten nie jest sprzeczny z
uprawnieniami wynikającymi z umowy; powinien również liczyć się z potrzebami
innych mieszkańców i sąsiadów. Art. 684. Najemca
może założyć w najętym lokalu oświetlenie elektryczne, gaz, telefon, radio i
inne podobne urządzenia, chyba że sposób ich założenia sprzeciwia się
obowiązującym przepisom albo zagraża bezpieczeństwu nieruchomości. Jeżeli do
założenia urządzeń potrzebne jest współdziałanie wynajmującego, najemca może domagać
się tego współdziałania za zwrotem wynikłych stąd kosztów. Art. 685. Jeżeli
najemca lokalu wykracza w sposób rażący lub uporczywy przeciwko
obowiązującemu porządkowi domowemu albo przez swoje niewłaściwe zachowanie
czyni korzystanie z innych lokali w budynku uciążliwym, wynajmujący może
wypowiedzieć najem bez zachowania terminów wypowiedzenia. Art. 6851. (256) Wynajmujący lokal może podwyższyć
czynsz, wypowiadając dotychczasową wysokość czynszu najpóźniej na miesiąc
naprzód, na koniec miesiąca kalendarzowego. Art. 686. Ustawowe
prawo zastawu wynajmującego lokal mieszkalny rozciąga się także na wniesione
do lokalu ruchomości członków rodziny najemcy razem z nim mieszkających. Art. 687. Jeżeli
najemca lokalu dopuszcza się zwłoki z zapłatą czynszu co najmniej za dwa
pełne okresy płatności, a wynajmujący zamierza najem wypowiedzieć bez
zachowania terminów wypowiedzenia, powinien on uprzedzić najemcę na piśmie,
udzielając mu dodatkowego terminu miesięcznego do zapłaty zaległego czynszu. Art. 688. Jeżeli
czas trwania najmu lokalu nie jest oznaczony, a czynsz jest płatny
miesięcznie, najem można wypowiedzieć najpóźniej na trzy miesiące naprzód na
koniec miesiąca kalendarzowego. Art. 6881. (257) § 1. Za zapłatę czynszu i
innych należnych opłat odpowiadają solidarnie z najemcą stale zamieszkujące z
nim osoby pełnoletnie. § 2. Odpowiedzialność
osób, o których mowa w § 1, ogranicza się do wysokości czynszu i innych opłat
należnych za okres ich stałego zamieszkiwania. Art. 6882. (258) Bez zgody wynajmującego najemca nie
może oddać lokalu lub jego części do bezpłatnego używania ani go podnająć.
Zgoda wynajmującego nie jest wymagana co do osoby, względem której najemca
jest obciążony obowiązkiem alimentacyjnym. Art. 689. (259) (skreślony). Art. 690. (260) Do ochrony praw najemcy do
używania lokalu stosuje się odpowiednio przepisy o ochronie własności. Art. 691. (261) § 1. W razie
śmierci najemcy lokalu mieszkalnego w stosunek najmu lokalu wstępują:
małżonek niebędący współnajemcą lokalu, dzieci najemcy i jego współmałżonka,
inne osoby, wobec których najemca był obowiązany do świadczeń
alimentacyjnych, oraz osoba, która pozostawała faktycznie we wspólnym pożyciu
z najemcą. § 2. Osoby
wymienione w § 1 wstępują w stosunek najmu lokalu mieszkalnego, jeżeli stale
zamieszkiwały z najemcą w tym lokalu do chwili jego śmierci. § 3. W
razie braku osób wymienionych w § 1 stosunek najmu lokalu mieszkalnego
wygasa. § 4. Osoby,
które wstąpiły w stosunek najmu lokalu mieszkalnego na podstawie § 1, mogą go
wypowiedzieć z zachowaniem terminów ustawowych, chociażby umowa najmu była
zawarta na czas oznaczony. W razie wypowiedzenia stosunku najmu przez
niektóre z tych osób stosunek ten wygasa względem osób, które go
wypowiedziały. § 5. Przepisów
§ 1-4 nie stosuje się w razie śmierci jednego ze współnajemców lokalu
mieszkalnego. Art. 692. Przepisów
o wypowiedzeniu najmu przez nabywcę rzeczy najętej nie stosuje się do najmu
lokali mieszkalnych, chyba że najemca nie objął jeszcze lokalu. |
TITLE
XVII. LEASE AND TENANCY SECTION
I. LEASE Chapter
1. General
Provisions Article 659. § 1. By the contract of lease,
the lessor assumes the obligation to give the lessee a thing for use for a
specified or unspecified time, and the lessee assumes the obligation to pay
the lessor the agreed rent. § 2. The rent may be determined in money
or in performances in kind. Article 660. The contract of lease of an
immovable property or premises for a period longer than one year shall be
concluded in writing. In the case of non-observance of that form the contract
shall be deemed to have been concluded for indefinite time. Article 661. The
contract of lease concluded for a period longer than ten years shall be
deemed, after the lapse of that period, to have been concluded for indefinite
time. Article 662. § 1. The lessor shall release to
the lessee the thing in a condition suitable for the use agreed upon and
maintain it in such condition throughout the period of the lease. § 2. Small outlays connected with the
ordinary use of the thing shall encumber the lessee. § 3. If the thing leased has been
destroyed as a result of circumstances for which the lessee is not liable, he
shall have no obligation to restore it to its former condition. Article 663. If, during the period of the
lease, the thing requires repairs which encumber the lessor and without which
the thing is not suitable for the use agreed upon, the lessee may set the
lessor an appropriate time limit for making the repairs. After an ineffective
lapse of that time limit, the lessee may make the necessary repairs at the
cost of the lessor. Article 664. § 1. If the thing leased has
defects which limit its suitability for the use agreed upon, the lessee may
demand the appropriate reduction of the rent for the period of the duration
of such defects. § 2. If at the time of being released to
the lessee the thing had defects which made it impossible to use it in the
way envisaged in the contract, and if such defects arose later, and the
lessor in spite of being notified about the fact failed to remove them in an
appropriate time, or if the defects cannot be removed, the lessee may
terminate the lease without observing the time limit for the notice. § 3. The claims for a reduction of the
rent due to the defects of the thing leased, and the right to an immediate
termination of the lease cannot be made by the lessee if he knew about the
defects at the time of concluding the contract. Article 665. If a
third party vindicates against the lessee claims pertaining to the thing
leased, the lessee shall immediately notify the lessor about the fact. Article 666. § 1. During the period of the
lease, the lessee shall use the thing leased in the manner specified in the
contract, and if the contract does not specify the manner of use, in a manner
corresponding to the nature and designation of the thing. § 2. If, during the period of the lease,
there arises the need for making repairs which encumber the lessor, the
lessee shall immediately notify the latter about the fact. Article 667. § 1. Without the consent of the
lessor, the lessee cannot make in the thing leased changes at variance with
the contract or with the designation of the thing. § 2. If the lessee uses the thing in a
manner inconsistent with the contract or with the designation of the thing
and in spite of a warning does not cease to use it in such manner, or if he
neglects the thing so much that it is exposed to loss or damage, the lessor
may terminate the contract of lease without observing the time limit for the
notice. Article 668. § 1. The
lessee may give the thing leased as a whole or in parts to a third party for
gratuitous use or sublease if the contract does not prohibit him to do so. If
the thing is given to a third party both the lessee and the third party shall
be liable to the lessor for the thing leased being used in accordance with
the duties resulting from the contract of lease. § 2. The relationship resulting from the
contract of gratuitous use or sublease concluded by the lessee expires at the
latest at the time of termination of the relationship of lease. Article 669. § 1. The lessee shall be obliged
to pay the rent on the date agreed upon. § 2. If the date of payment of the rent
is not specified in the contract, the rent shall be paid in advance, namely:
if the lease is to last not longer than one month, for the whole period of
lease, and if the lease is to last longer then one month or if the contract
is for indefinite time, monthly, not later than on the tenth day of each
month. Article 670. § 1. To secure the rent and the
additional performances with which the lessee is in arrears not longer than
for one year, the lessor shall have the statutory right of pledge on the
movable things of the lessee brought in to the object of the lease unless
such things are exempt from seizure. § 2. Repealed. Article 671. § 1. The lessor's statutory
right of pledge shall expire when the things encumbered by pledge are removed
from the object of lease. § 2. The lessor may oppose the removal
of the thing encumbered by pledge and keep it at his own risk until the rent
in arrears is paid or secured. § 3. If the things encumbered by pledge
are removed upon an order of a State authority, the lessor shall retain the
statutory right of pledge if he reports it to the authority which has ordered
the removal. Article 672. If the
lessee is in arrears with payment of the rent for at least two full periods
of payment, the lessor may terminate the contract of lease without observing
the time limit for the notice. Article 673. § 1. If the period of the lease
is not specified both the lessor and the lessee may terminate the contract of
lease with the observance of the contractual time limits for notice, and in
their absence - with the observance of the statutory time limits. § 2. The statutory time limits for the
termination of the lease by notice shall be as follows: if the rent is
payable in periods longer than one month, the lease may be terminated by
giving notice at the latest three months in advance at the end of a calendar
quarter; if the rent is payable monthly, one month in advance at the end of a
calendar month; if the rent is payable in shorter periods, three days in
advance; if the lease is daily, one day in advance. § 3. If the period of the lease is
specified, both the lessor and the lessee may terminate the contract of lease
by a notice in the events provided for in said contract. Article 674. If, after
the lapse of the time specified in the contract or in the notice, the lessee
continues to use the thing with the consent of the lessor, it shall be
deemed, in case of doubt, that the lease has been extended for indefinite
time. Article 675. § 1. After the end of the lease,
the lessee shall be obliged to return the thing in a non-deteriorated
condition; however, he shall not be liable for the wear and tear of the thing
as a result of its correct use. § 2. If the lessee gave the thing to
another person for gratuitous use or for sublease, the above duty shall be borne
by that person, too. § 3. It shall be presumed that the thing
which was given to the lessee was in a good and appropriate condition for its
contractual use. Article 676. If the
lessee has improved the thing leased, the lessor, in the absence of a different
agreement, may, according to his choice, either retain the improvements
against the payment of the sum corresponding to their value at the time of
returning the thing or demand the restoration of the previous condition. Article 677. The
lessor's claims against the lessee for the repair of the damage due to the
impairment or deterioration of thing, as well as the lessee's claims against
the lessor for the return of the outlays on the thing or the reimbursement of
the overpaid rent shall be barred by limitation of one year from the return
of the thing. Article 678. § 1. If the thing leased is sold
during the period of the lease the acquirer shall replace the transferor in
the relationship of lease; he may, however, terminate the lease while
observing the statutory time limits for notice. § 2. The above right to terminate the
lease by notice cannot be vested in the acquirer if the contract of lease was
concluded for definite time in writing and an authenticated date, and the
thing was released to the lessee. Article 679. § 1. If, as a result of the
termination of the lease by the acquirer of the thing leased, the lessee must
return the thing earlier than he would have been obliged under the contract
of lease, he may demand from the transferor the redress of the damage. § 2. The lessee shall immediately notify
the transferor about the earlier termination of the contract by notice by the
acquirer; otherwise the transferor shall have the right to raise against the
lessee all defences which the lessee failed to raise, and the rising of which
would have resulted in the ineffectiveness of the termination of the contract
by notice on the part of the acquirer. Chapter
2. Lease of
Premises Article 680. With the observance of the
below-mentioned provisions, the provisions of the preceding Chapter shall
apply to the lease of premises. Article 680(1). § 1.
Irrespective of the property relations existing between spouses, both of them
shall be lessees of the premises if the relation of lease of the premises
supposed to satisfy housing needs of their family has been established during
their marriage. In the case of spouses' properties being separated, the
provisions on statutory conjugal community shall apply to the joint lease. § 2. Termination of a statutory conjugal
community during the marriage shall not cause termination of the joint lease
of the premises. However, by applying respective provisions on termination of
property co-ownership, for important reasons and at the request of one of the
spouses, the court may terminate the joint lease of the premises. Article 681. The minor outlays to be made by
the lessee of living accommodation and business premises shall include in
particular: minor repairs of floors, doors and windows, the painting of the
walls, floors and the innerside of entrance doors, as well as the minor
repairs of technical facilities which ensure lighting and heating of the
premises and the inflow and outflow of water. Article 682. If the defects of the premises
leased are such that they are health hazards to the lessee or members of his
household or persons employed by him, the lessee may terminate the contract
of lease by notice without observing the time limits for serving the notice
even if he knew about the defects at the time of concluding the contract. Article 683. The lessee of the premises shall
observe the rules of maintaining order in the building if these are not
contradictory to his rights resulting from the contract of lease; he shall
also count with the needs of other inhabitants and neighbours. Article 684. The
lessee may install in the premises leased electric lighting, gas, telephone,
radio sets and other similar equipment unless the manner of installing them
would be contradictory to the provisions in force or threatens the security
of the premises. If the equipment requires the co-operation of the lessor,
the lessee may demand such co-operation against the reimbursement of the
resulting costs. Article 685. If the lessee of premises
glaringly or obstinately transgresses the accepted house rules or by his
improper conduct makes the use of other premises in the building difficult,
the lessor may terminate the contract of lease without observing the time
limit for the notice. Article 685(1). If the
period of lease of a living accommodation is not specified, the lessor may
increase the amount of rent by terminating by notice of the to-date amount at
the end of a calendar month and one month before the planned increase, at the
latest. Article 686. The statutory right of pledge of
the lessor of living accommodation shall also cover the movables brought into
the premises by members of the family of the lessee who live with him. Article 687. If the
lessee of the premises is in arrears with the payment of the rent for at
least two full periods of payment, and the lessor intends to terminate the
contract of lease without observing the time limit for the notice, he shall
warn the lessee in writing setting him an additional time limit of one month
for the payment of the rent in arrears. Article 688. If the
time of the duration of the lease is not definite and the rent is payable
monthly, the contract of lease may be terminated by notice at the latest
three months before the end of a calendar month. Article 688(1). § 1. The
liability for payment of rent and other due charges shall be jointly and
severally borne by both the lessee and adult persons permanently residing
with him. § 2. The liability of the persons
referred to in paragraph 1 above shall be limited to the amount of rent and
other charges due for the period of their permanent residence. Article 688(2). Without
the consent of the lessor, the lessee cannot make the premises available
either as a whole or in part for gratuitous use nor sublease it. The consent
of the lessor shall not be required in the case where it refers to the person
the lessee is obliged to maintain or pay alimony dues to. Article 689. Repealed.
Article 690. The
provisions on the protection of ownership shall apply respectively to the
protection of the rights of the lessee to use the premises. Article 691. § 1. Where the lessee of a
living accommodation has deceased, the relation of lease of a living
accommodation shall be entered into by: the spouse not being a co-lessee of
such accommodation, children of the lessee and of the lessee's spouse, other
persons the lessee was obliged to maintain or pay alimony dues to, and the
person the lessee actually cohabited with. § 2. The persons referred to in
paragraph 1 shall enter into the relation of lease of a living accommodation
if they inhabited the accommodation together with the lessee until his death. § 3. Where there are no persons referred
to in paragraph 1, the relation of lease of a living accommodation shall
expire. § 4. Persons who, under paragraph 1, entered
the relation of lease of a living accommodation may terminate the relation
with the observance of statutory time limits even if the contract was
concluded for a specified time period. Where the relation of lease of a
living accommodation is terminated by a notice by some of such persons, the
termination shall be valid with respect to the persons who gave an
appropriate notice. § 5. The provisions of paragraphs 1 to 4
shall not apply in the case of death of one of the co-lessees of a living
accommodation. Article 692. The
provisions on the termination of the contract of lease by notice on the part
of the acquirer of the thing leased shall not apply to the lease of living
accommodation unless the lessee has not yet occupied the premises. |
